Welcome to Profile Next Career Services ("we", "our", "us"). These Terms & Conditions govern access to and use of our website and professional services. By accessing our website, communicating with us, submitting your information, or making any payment for our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms in accordance with the applicable laws of India.

If you do not agree to these Terms, you must not access or use our services.

1. About Us

Profile Next Career Services provides professional resume writing, LinkedIn optimization, and Naukri optimization services. We operate as an independent professional services provider based in India.

Profile Next Career Services is not a recruitment agency, placement consultancy, staffing firm, or employment provider. We do not offer job placement services or employment guarantees.

2. Services Offered

Our services may include:

• Resume writing and complete restructuring
• ATS-friendly resume formatting based on industry best practices
• LinkedIn profile optimization
• Naukri profile optimization
• Resume uploads to client-owned job portals
• Restriction of access to completed work until payment is received
• Optional cover letter drafting (if included in selected service scope)
• Limited post-delivery support for up to six (6) months

Services are customized based on individual client requirements.

We do not:

• Guarantee job placement
• Apply to jobs on your behalf
• Message recruiters on your behalf
• Guarantee interviews or salary increases

3. No Employment Guarantee

Our services are optimization and advisory in nature. Employment outcomes depend on multiple external factors, including market conditions, recruiter decisions, competition, industry demand, and platform algorithms.

ATS scores generated by third-party tools are provided for reference purposes only and do not guarantee performance within employer-specific Applicant Tracking Systems.

We do not guarantee interviews, job offers, recruiter responses, salary increases, or specific profile visibility results.

4. ATS Optimization Disclaimer

Resumes are structured according to commonly accepted Applicant Tracking System (ATS) best practices and may be evaluated using third-party industry tools.

Different employers use proprietary and customized ATS software, and compatibility or scoring may vary across platforms.

Any ATS-related score, analysis, or evaluation is provided for indicative and reference purposes only and does not guarantee performance, shortlisting, or employer system ranking.

We are not responsible for algorithm changes made by recruitment platforms or employer systems.

5. Client Responsibilities

By using our services, you agree to:

• Provide accurate, complete, and truthful information
• Disclose full employment, education, and experience details
• Review drafts and provide feedback within the agreed timelines
• Make all agreed payments on time
• Change account passwords at your discretion. Where ongoing support requires temporary access, credentials must be shared voluntarily and solely for agreed service purposes.

The Client acknowledges that sharing login credentials may be subject to third-party platform policies and agrees that we are not liable for any action taken by such platforms unless caused by intentional misconduct.

We rely entirely on the information provided by you and are not responsible for outcomes, inaccuracies, or consequences arising from incomplete, misleading, or false information supplied by you.

The Client is solely responsible for reviewing and verifying all documents before submitting them to employers or third-party platforms.

6. Account Access & Platform Use

If the Client voluntarily provides login credentials for LinkedIn, Naukri, or any other third-party platform for profile optimization purposes:

• Access will be used strictly for agreed service-related updates
• Credentials will not be permanently stored
• Credentials will be deleted after completion of the relevant service activity
• The Client is advised to enable two-factor authentication (2FA)

The Client acknowledges that sharing login credentials is done voluntarily and at their own discretion.

Third-party platforms may have their own terms regarding account access and credential sharing. We are not responsible for actions, restrictions, suspensions, or penalties imposed by such platforms unless directly caused by our intentional misconduct.

7. Payment Terms

• A 50% advance payment is required before commencement of work
• The remaining 50% balance payment must be completed before final delivery of documents
• Payments may be made via UPI, bank transfer, or any mutually agreed method
• Making any advance payment constitutes full acceptance of these Terms

All payments are non-transferable and are exclusive of applicable taxes, if any.

If full payment is not received:

• Final documents and deliverables may be withheld
• Ongoing support services may be suspended
• Access to completed materials may be restricted until payment is made

8. No Refund Policy

Due to the customized and time-intensive nature of our services, all payments made are non-refundable once work has commenced.

Advance payments are non-refundable after service initiation, as work begins immediately upon project confirmation.

No refunds shall be issued after draft documents have been delivered and revision opportunities have been provided.

In the unlikely event that services are not delivered as agreed due to our failure to perform, appropriate corrective action shall be taken at our discretion.

8.1 Indemnification

The Client agrees to indemnify, defend, and hold harmless Profile Next Career Services, its owners, affiliates, and representatives from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

• False, inaccurate, misleading, or incomplete information provided by the Client
• Misuse of the resume, profile, or documents after delivery
• Violation of third-party platform policies by the Client
• Any claim made by an employer, recruiter, or third party relating to the Client's submitted information
• Any breach of these Terms by the Client

This indemnification obligation shall survive termination of services.

9. Revision Policy

• Two (2) revisions are included per project
• Revision requests must be made within seven (7) days of draft delivery

Revisions are limited to refinements based on the originally provided information. Major scope changes, additional experience additions, or structural changes beyond the agreed scope may require additional charges.

10. Six-Month Support

We provide limited support for up to six (6) months from final delivery.

Support includes:

• Minor keyword refinements
• Minor LinkedIn/Naukri profile updates
• Limited guidance via message or call (subject to availability)

Support does not include:

• Complete resume rewrites
• Career domain changes
• Major restructuring of documents
• Unlimited revisions or continuous edits beyond the included revision limit

If the Client remains unresponsive for thirty (30) consecutive days, the project may be placed on hold. Reactivation of services may require an administrative fee of up to twenty percent (20%) of the total agreed service fee.

Support services are available only after full payment has been completed.

11. Termination

We reserve the right to suspend or terminate services immediately, without prior notice, if:

• Abusive, threatening, or inappropriate behavior occurs
• Payment obligations are not fulfilled
• Material misrepresentation or false information is discovered

In such cases, no refunds shall be issued for any payments already made.

12. Intellectual Property

Upon full and final payment, the Client shall receive ownership rights to the final customized resume content and documents created specifically for the Client's personal professional use.

All templates, formatting structures, designs, methodologies, proprietary processes, tools, training materials, branding elements, and underlying frameworks used in delivering the services remain the exclusive intellectual property of Profile Next Career Services.

Such proprietary materials may not be copied, reproduced, resold, distributed, modified for commercial use, or shared with third parties without prior written consent.

13. Data Handling

Client information is stored using restricted-access cloud storage systems with reasonable technical and administrative security safeguards.

Client data may be retained for up to six (6) months from the date of final service delivery for support and record-keeping purposes, unless a longer retention period is required by law.

Data may be deleted earlier upon written request from the Client, subject to legal or contractual obligations.

While we implement reasonable security measures, no method of electronic storage or transmission over the internet is completely secure, and we cannot guarantee absolute security.

Our data handling practices are governed by our Privacy Policy and applicable laws of India.

14. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the services provided shall not exceed the total amount actually paid by the Client for the specific service giving rise to the claim.

Under no circumstances shall we be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of income, loss of opportunity, reputational harm, or business interruption.

We are not liable for employment decisions, platform algorithm changes, recruiter actions, market conditions, or any third-party platform policies or technical issues.

15. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India.

Any dispute, controversy, or claim arising out of or in connection with these Terms or the services provided shall first be attempted to be resolved amicably between the parties.

If unresolved within thirty (30) days, the matter shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. If the parties fail to agree on appointment, the arbitrator shall be appointed in accordance with applicable law.

The seat and venue of arbitration shall be the state in which the Company's registered office is located at the time of dispute. The language of arbitration shall be English.

Subject to the above, courts located within such state shall have exclusive jurisdiction.

16. Age Requirement

Our services are available only to individuals aged 18 years or above. By using our services, you represent and warrant that you are at least 18 years of age.

17. Changes to Terms

We reserve the right to update or modify these Terms & Conditions at any time at our sole discretion. Updated versions will be posted on our website with a revised effective date.

Continued use of our website or services after any updates constitutes your acceptance of the revised Terms.
